All Contractors, including interior and exterior Painters, Plumbers, Electricians and Landlords who perform work in homes, daycares, kindergartens and preschools built before 1978 must follow EPA’s new lead paint regulations.
As of April 22, 2010, contractors performing interior and or exterior renovation, repair, and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be licensed and follow specific lead safe work practices to prevent lead contamination. Anyone compensated for their work that disturbs more than 6 square feet of interior surface or 20 square feet of exterior surface can be fined $37,500 per day per infraction by EPA for non-compliance.
RULE SUMMARY
Training; Anyone who is compensated for their work in a Pre-1978 dwelling, daycare or elementary school must attend the 8 Hour Renovator/ Remodeler class. (Only 1 Licensed person is needed per jobsite as long as all other workers have received in house training).
Licensing: Once an individual has successfully completed the 8 Hour Renovator, Repair & Painting class they must obtain the Renovator/ Remodeler License from RI Department of Health.
Notification; Before any work can begin occupants of the dwelling and RI Department of Health must be given written notice of when the work will begin. Contractors also have to provide the occupants with the RENOVATE RIGHT pamphlet.
Lead Safe Work Practices; Contractors who disturb paint must follow lead safe work practices which include posting warning signs, containing lead dust, disposing of waste properly and toughly cleaning the work area.
Clearance Inspection; At the completion of every job a Licensed Lead Inspector/ Technician must contacted to visually clear the construction area and take clearance samples.
Record Keeping; It is the contractor’s responsibility to retain all work notices, disclosure forms, inspection reports, clearance certificates. EPA can audit you and your company.
