Lead Liability Insurance
 


This Certification was established through the 2002 Lead Mitigation Act. It was to establish an acceptable level of lead paint safety in pre-1978 residential rental units. All painted areas on the exterior and interior of the house has to be painted and intact. There cannot be any cracking, peeling or chipping paint. The pre-1978 windows in the dwelling will have to be addressed and there can be no binding doors.
     
To qualify for this certificate a landlord must:
     
 
Landlord or designee must Attend the 3 hour Lead Hazard Awareness Seminar
 
Inspect your property for lead hazards
 
Repair all lead hazards using proper protocols
 
Thoughly wash each dwelling unit
 
All soil within 5 feet of the dwelling and play areas must be covered or made inaccessible to children
 
Inspection conducted by an Independent Environmental Lead Inspector or Inspector Technician
 
Give tenants a copy of all lead information and reports
 
Certificate is good for 2 years

This certificate can be renewed by an individual who has taken the 3 Hour Lead Hazard Awareness Seminar as long as there has not been any change in tenancy. A walk through of the unit is necessary to ensure that there is no peeling, cracking, or chipping paint, no wood on wood friction surfaces or binding areas. This inspection will have to be notarized and is good for another 2 years.
 
Presumptive Compliance :
 
The Lead Mitigation Act of 2002 established this certificate. The same conditions apply as with the Certificate of Conformance in addition to the following:
 
Can be issued by a Licensed Environmental Lead Inspector or Environmental Lead Technician.
10 or more rental units built after 1960 on the same lot.
Conduct an inspection with an independent licensed lead inspector in accordance with the Certificate of Conformance regulations on at least 5% of rental units – not less than 2 units in each building.
Valid for 1 year.
Must inspect a different 5% annually upon renewal of certificate.
